★ There will be another court for 2.9 Tatekawa Crackdown case on November 19th.
In the previous court on October 3rd the presiding judge Shoichi Yagi forced 3 people including the accused Mr. Ryota Sono out of the court, dismissed all evidences and witnesses and declared conclusion of the trial with no consideration of the case.
How could we expect a decent judgement from such a tyrannical judge?
For the details of the case and the court proceeding see https://solfeb9.wordpress.com/2013/10/17/.
Police has been conducting strict crackdowns on demonstrations and protests since the 3.11 Great East Japan Earthquake. A comrade in Kansai area, however, who was indicted for obstructing executive officer, won a not guilty decision. Another comrade, after a year struggle for withdrawal of his case, finally won. Mr. Sono has also held his stand and continued to demand a just and fair judgement.
★ Any form of protest activities could be charged of forcible obstruction of business.
Mr. Sono was arrested on February 9th while protesting against forcible eviction of homeless people and their huts from Tatekawa River Park, and was sentenced to one year in prison with probation of three years in the lower court. The protest against this outrage was made into a crime. The Campaign for the Accused of the 2.9 Tatekawa Crackdown Case cannot accept the decision and has been struggling for the reverse as people could otherwise easily be charged just for taking part in a protest activity.
★ We demand Tokyo High Court should hold trial before rendering a decision, and that the accused should be found not guilty.
We tried to hand a statement calling the court for holding trial and a not-guilty ruling to Mr. Sono to the court on November 1st but as we entered the site a dozen of court officials blocked the entrance and eventually called in the police.
For the statement and the list of signatories visit https://solfeb9.wordpress.com/2013/10/23/.
Every time the judge forces the accused and/or the public out of the court, and every time the court blocks us from entering the court building the Japanese judicial system virtually admits its increasingly reactionary stance and the injustice of the lower court decision.
We should make it clear in the court that it is not Mr. Sono but Koto Ward Office that forcibly evicted homeless people, the police that unjustifiably arrested and detained him in the notorious pre-trial detention system known as daiyokangoku and the courts trying to give endorsements to the violations of human rights committed by Koto Ward Office and the police who should be accused. We need to stop violence of the judge and the court officials, prevent the high court from upholding the lower court decision and win a not guilty decision. In order to achieve these we hope as many people as possible will join in the demonstration and observe the appeal.
★ Please send your protest message to Tokyo High Court.
